Judge Feldman grants preliminary injunction lifting moratorium on deepwater drilling

U.S. District Court Judge Martin L.C. Feldman in New Orleans yesterday issued a preliminary injunction against the federal government's six-month moratorium on deepwater drilling. The suit was brought by Hornbeck Offshore Services and other offshore companies that provide services in the Gulf of Mexico. Hornbeck claims that the federal government's moratorium is arbitrary, capricious, an abuse of discretion, or not in accord with the law. Judge Feldman ruled that Hornbeck had a substantial likelihood of prevailing and that it would suffer irreparable harm if the moratorium was not lifted. In summary, the judge states that the federal government is sweeping with too broad a brush based on faulty analysis, harming people and companies that work in the Gulf that had no involvement in the Deepwater Horizon disaster.
